Introduction and Acceptance of Terms

Welcome to SongsOfDreams, a small web app that turns your written stories into complete songs. By accessing or using our website and related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, please stop using SongsOfDreams.

Description of the Service

SongsOfDreams provides registered users with the ability to:

  • Enter written stories or text and generate songs with melody, vocals, and cover art;
  • Save generated songs to a personal library for later listening;
  • Optionally turn on public sharing for certain songs and share a link with others;
  • Access other related features we may introduce in the future.

We may adjust, expand, or limit parts of the service over time and will provide reasonable notice where appropriate.

User Accounts and Registration

  1. Account Creation

    • You must create an account to access certain features of the service;
    • During registration, you should provide the account information requested on the page and update it when there are material changes.

  2. Account Security

    • You are responsible for maintaining the confidentiality of your login credentials;
    • You are responsible for all activities that occur under your account, whether or not authorized by you.

  3. Notification of Unauthorized Use

    • If you become aware of any unauthorized use of your account or any other security breach, you agree to notify us promptly using the contact information at the end of these Terms.

User Content and Intellectual Property

  1. User Content Definition

    • Text you submit to the service (for example, stories and notes);
    • Content generated by the system based on your input, including songs, lyrics, cover images, and related metadata;
    • Any other material you create, upload, or share through the service.

  2. Ownership and License

    • Subject to applicable law, you retain any rights you lawfully hold in your User Content;
    • By using the service, you grant SongsOfDreams a non-exclusive, worldwide, revocable, royalty-free license, with the right to sublicense solely as needed to:
      • Provide, operate, and display the service to you (for example, showing your songs in your library or on public share pages);
      • Store and back up your content to maintain service reliability and security;
      • Use your content for product or case showcases only with your explicit consent.

  3. Service Content and Trademarks

    • Except for User Content, all rights in the SongsOfDreams service (including code, design, UI, text, logos, and trademarks) are owned by us or our licensors;
    • You may not copy, modify, distribute, sell, or use any part of the service for creating competing products or services without our prior written consent.

Acceptable Use and Prohibited Conduct

When using SongsOfDreams, you agree not to engage in any unlawful, harmful, or otherwise inappropriate behavior, including but not limited to:

  • Submitting, generating, or sharing content that:
    • Is illegal, infringing, hateful, harassing, obscene, or discriminatory;
    • Violates the privacy, publicity, copyright, or other rights of any person or entity;
    • Contains fraudulent, misleading, or intentionally false information;
  • Using the service to conduct or support any illegal activities;
  • Attempting to interfere with, disrupt, or compromise the security or performance of the service (for example, attacking servers or abusing APIs);
  • Scraping, crawling, or otherwise collecting data from the service at scale without our permission;
  • Reselling, renting, or providing SongsOfDreams as a commercial service (such as bulk generation for third parties) without our prior written approval.

If we reasonably believe that you have violated these rules, we may take appropriate measures, including limiting certain features, removing content, suspending or terminating your account, and, where appropriate, reporting to relevant authorities.

Our collection, use, and protection of your personal data and content are described in detail in our separate Privacy Policy.

  • You can access it via the link in the site footer;
  • If there is any inconsistency between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy will prevail.

Pricing, Credits, and Payments

  1. Pricing and Changes

    • Certain features may require payment or the use of credits;
    • We may change prices or plan structures from time to time and will provide reasonable notice where required.

  2. Payments and Refunds

    • As a general rule, we do not offer refunds without a specific reason;
    • If you request a refund through a third-party payment provider, we will assess whether a full or partial refund is appropriate based on the value of services already used (for example, credits consumed), the rules of the payment platform, and reasonable handling costs;
    • You must ensure that your chosen payment method is valid and that you are authorized to use it.

  3. Non-Payment and Restrictions

    • If a payment fails or an account is in arrears, we may temporarily limit access to certain features until the issue is resolved.

Service Changes and Termination

  1. Service Modifications

    • We may modify, update, suspend, or discontinue parts of the service at any time for reasons such as product improvements, security, or operations;
    • For significant changes, we will use reasonable efforts to provide notice.

  2. Your Termination

    • You may stop using the service at any time. You can delete your account through the self-service option in your account settings.

  3. Our Right to Suspend or Terminate

    • We may suspend or terminate your access to the service immediately if you seriously or repeatedly violate these Terms or applicable laws, or if your behavior risks harm to other users, us, or third parties.

Disclaimer of Warranties

To the fullest extent permitted by law:

  • The service is provided on an "as is" and "as available" basis;
  • We do not guarantee that the service will be error-free, uninterrupted, or meet your specific expectations at all times;
  • We are not responsible for issues caused by factors beyond our reasonable control, including network problems, third-party service outages, or force majeure events.

You understand and agree that generated songs and artwork are based on algorithms and models and may not always match your subjective artistic preferences. This does not constitute a product defect.

Limitation of Liability

To the maximum extent permitted by applicable law, SongsOfDreams shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business interruption) arising out of or in connection with your use of or inability to use the service.

Where liability cannot be excluded but may be limited, our total aggregate liability to you for all claims arising out of or related to the service will not exceed the total amount you have paid to us for the service in the 12 months preceding the event giving rise to the claim (or zero if you are using the service for free).

Changes to These Terms

We may update these Terms from time to time as our service evolves or as laws and regulations change.

  • When there are material changes, we will use reasonable means to notify you, such as displaying a notice on the website;
  • Your continued use of the service after such changes take effect constitutes your acceptance of the updated Terms.
